Police Officer Applicant Rejection Criteria
- Any of the following items may result in the permanent rejection of an applicant.
- Knowingly omit or falsify any information on the application or on the personal history statement.
- Conviction of any offense above a Class B misdemeanor.
- Admission or discovery of current and/or recent substance abuse.
- Admission or discovery of the manufacture, delivery, sale or possession with the intent to sell or deliver any controlled substance.
- Termination from any law enforcement agency for cause. ("For Cause" means an affirmed termination due to an action, or failure to act by the applicant.)
- 6. Asked to resign or resigned while under investigation from a law enforcement agency (does not include economic lay-off).
- 7. Conviction in
militarycourt which resulted in discharge from military service under less than honorable conditions.
- 8. Conviction of two or more Class B misdemeanors.
- 9. Conviction of any
- 10. False Statement to Interview Board - Any applicant who knowingly gives false information during the oral interview will be disqualified from future selection processes.
- 11. Failure of a law enforcement employment related polygraph, psychological and/or drug screen examination will result in permanent rejection.
Any oneof the following items may result in the rejection of an applicant for the period specified for each item.
- Conviction of the offense of driving while intoxicated or driving while under the influence of drugs – ten (10) years from the date of conviction.
- Conviction of a Class B misdemeanor - ten (10) years from the date of conviction.
- Conviction of a Class C misdemeanor other than a traffic violation - One (1) year from the date of conviction.
- Conviction of two (2) or more Class C misdemeanors other than traffic violations - Two (2) years from the date of the last conviction.
- Admission or discovery of valid warrant(s) of arrest - One (1) year from date of application and proof warrant(s) have been cleared or otherwise adjudicated.
- Termination for cause from two (2) jobs within a five (5) year period. ("For Cause" means affirmed termination due to an action or failure to act on the part of the applicant.) - Five (5) years from the date of the last termination.
- Termination for cause from one (1) job, not law enforcement. ("For Cause" means an affirmed termination due to an
action offailure to act on the part of the applicant.) - Two (2) years from the date of termination.
- Documented instances of unstable job history or unstable job performance, such as:
- An excessive number of jobs of short duration - Four (4) or more jobs within a five (5) year period. To be reviewed or considered on a case-by-case basis.
- Poor performance, poor attitude, poor relations with the public, inability to be trained, irresponsibility or dishonesty. To be reviewed or considered on a case-by-case basis
A sustained disqualification will result in a two (2) year rejection from the date of application.
- Financial problems such as IRS lien or garnishment, judgment for non-payment or admission of non-payment of child support. A sustained disqualification will be for a period of two (2) years.
- Conduct contrary to the standards of the police service, such as association with persons known to engage in criminal activity, when such conduct is outside the necessity of such association required by the duties of a police officer.
- It will be presumed that the applicant is aware
orthe records of activities of those with whom he/she associates unless the applicant can provide information or evidence to the contrary.
- It will be presumed that the applicant is aware of the activities of any group or organization of which he/she is a member unless the applicant can provide information or evidence to the contrary.
Rejection for any of the above will be determined upon a case-by-case review by the Department. Proven discontinuation of the activity, association or membership will be considered. A sustained disqualification will be for a period of two (2) years.
- It will be presumed that the applicant is aware
- Fail Oral Review Board - Any applicant who receives a failing score ( Any score below a 9 on the ORB is considered a failing score) from the Oral Review Board will be disqualified from future selection processes for a period of two (2) years from the date of the interview.
- Failure to provide all required documents at
timeapplication is due will result in a disqualification for a period of one (1) year from the date of application.
- Discovery of offenses committed by the applicant will be reviewed on a case-by-case basis as to their relevance in the rejection criteria.
- Offenses committed while in the military or in other jurisdictions will be reviewed as if they occurred in the State of Texas.
- If an applicant fails any portion of the Physical Training requirements
- They are eligible to apply for the next posted position.
Note: For the purposes of these criteria, a plea of no contest as well as deferred adjudication sentencing will be considered the same as a conviction.
